The present police investigation was initiated by executive order to establish the crime of culpable homicide, as stated in the record that on August 14, 2011 at 5:30 am on Avenida Angelina Pretty in quarantine in San Vicente, Welliton Ferrreira dos Santos was driving the vehicle plate Corsa JEH 1111 / S Vincent when he collided violently against a lamppost and a tree, having Welliton late due to the impact. The other vehicle's occupants were rescued.
Welliton died of head trauma as the report 432/11 (pgs 13-14), the toxicology report 13.987/11 tested positive for ethanol at a concentration of 1.3 g / l per liter of blood (15 pgs) ; a forensic award 5927/11 of the passenger car, Joab Manoel (Fls 23) and report 5928/11 from passing Natalie Adams (24 pgs). Natalie said Welliton drove at speed and had drunk alcohol at a party that night (25 pgs). Dolores Abigail who also was in the car said the Welliton had not taken alcohol (26 pgs). Joab said he had drunk alcohol (28 pgs). The police claimed that military people in the car could not tell what caused the accident (27 pgs). The report 8380/11 of the IC describes the scene of the accident (pgs 31-38)
